TREE MEDICS LLC - YARD DEBRIS CHIPS LIABILITY WAIVER

CLIENT LIABILITY WAIVER AND RELEASE FORM

This Liability Waiver and Release Form (the "Agreement") by and between TreeMedics LLC ("Company") and the undersigned property owner or authorized representative ("Client").

​

1. ACKNOWLEDGEMENT OF RISKS
Client acknowledges and understands that the delivery and placement of yard debris chips ("Wood Chips") on their property may result in certain risks, including but not limited to:

​

·         Temporary or permanent alteration of the landscape;

·         Potential presence of insects, fungi, or other organic matter in the chips;

·         Risk of smothering existing vegetation;

·         Discoloration of pavement or surrounding areas;

·         Potential displacement or runoff in heavy rain or wind conditions.

 

2. RELEASE OF LIABILITY
Client agrees to release, indemnify, and hold harmless TreeMedics LLC, its owners, employees, contractors, and affiliates from any and all claims, liabilities, damages, or losses, whether direct or indirect, arising from the delivery, placement, or use of the Wood Chips on Client’s property. This release includes, but is not limited to:

·         Any property damage or alteration caused by the delivery or placement of the Wood Chips;

·         Any personal injury resulting from contact with or exposure to the Wood Chips;

·         Any unforeseen consequences arising from the decomposition, movement, or use of the Wood Chips.

3. CLIENT RESPONSIBILITIES
Client understands and agrees that:

​

·         The location for Wood Chip delivery must be clearly marked and accessible by truck.

·         TreeMedics LLC is not responsible for any damages caused to driveways, sidewalks, or other structures due to truck access.

·         Client is solely responsible for the redistribution or removal of the Wood Chips after delivery.

·         Client understands that the Wood Chips are provided "as is" and may contain a mix of organic material.

4. NO WARRANTY
TreeMedics LLC makes no warranties, expressed or implied, regarding the quality, composition, or suitability of the Wood Chips for any particular use. TreeMedics LLC makes no guarantee that delivery will be made or as to a time frame of delivery.

5. CANCELLATION

You may cancel this agreement by calling our office at 503-683-2003 or sending an email that clearly states your intent to cancel to info@treemedicsnw.com.

6. ACCEPTANCE OF TERMS
By filling out the form below and clicking the submit button, Client acknowledges that they have read and understand this Agreement, accept the terms voluntarily, and assume all risks associated with the delivery and use of the Wood Chips.
